If You're A Terrorist Abroad, the Fact that You're an American is Only Incidental
This story at the Washington Post describing how the ACLU is suing the Administration under FOIA reminds me about a number of headlines I've seen at Drudge lately and a number of emails I've been getting about the targeted killing of Americans overseas.
The way you word things matters and I've become more and more annoyed over the past few years as many on the Right have increasingly adopted the phraseology of ardent Leftists. People who only a few years ago were die hard supporters of the war on terrorism today use phrases to make it seem that the same policies carried out under Bush are now leading to jack-booted-thuggery.
Clearly, there is a bit of Obama Derangement Syndrome happening here.
The particular wording I'm annoyed at today is the description of drone strikes as the "targeted killing of American citizens".
While the phrase is accurate, it's misleading.
We're at war. In a war, you kill your enemies. The fact that your enemies who are members or leaders of a foreign terrorist organization operating overseas are American is only incidental to the fact that they are terrorists.
We didn't kill Anwar al-Awlaki and Samir Khan because they were Americans. We killed them because they were terrorists.
This wasn't a case of the President of the United States killing a criminal in lieu of a trial. These were enemy combatants. You kill your enemies, you don't bring them to trial.
The fact that your enemy is an American citizen is irrelevant.
The idea which has been fostered by the Left for years and by some segments of the Right since Obama came to office that such authority could lead to the government rounding up citizens and killing them without a trial is nonsense based on two of the most rudimentary logical fallacies: slippery slope and hypothetical.
First, no US citizen has been killed when arresting that individual was an alternative. We've had hundreds of terrorists arrested in the US since 9/11, most of them have been US citizens, and all of them have received civilian trials.
The idea that the President might use his alleged authority to round people up is a hypothetical. It's never happened.
Second, the hypothetical is based on absurd slippery slope arguments. That since a President could detain or kill someone overseas without a civilian trial then what's stopping him from doing it on our own soil?
The thing that's stopping him is called The Constitution of the United States of America.
All of the arguments that the Patriot Act or the recently reauthorized NDAA somehow give the President cart blanch to extra-Constitutionally round up, detain, or kill American citizens on American soil just isn't true.
It doesn't matter how many sophisticated lawyers make the case, those arguments are still based on slippery slope reasoning and overlook the basic wording of the documents and the laws as actually practiced.
I get why Leftists hate our war against terrorists, but what I don't get is why some on the Right are equally adamant? The Left doesn't like war in general, and has historically adhered to our enemies with one exception -- WWII when our ally was communist Russia.
But on the Right? That's sheer Obama Derangement Syndrome.
The idea that we are going to fly FBI agents to Yemen, read members of al Qaeda their rights, and then bring them to Virginia for a trial is sheer fantasy. It's completely and utterly disconnected to reality.
Yet that is what you are arguing for if you oppose targeted assassinations or military trials. Unless, of course, you are arguing that the US should do nothing about jihadi terrorism, even when that terrorism is directly targeted against the United States.
Before 9/11 the policy of the US was to treat terrorists as criminals. After the USS Cole and African embassy bombings, President Clinton sent in the FBI to investigate.
Yeah, that did a lot of good. 9/11 was an outgrowth of that policy position.
So, if you want to go back to that model then, by all means, keep advocating for an end to drone strikes and military commissions.
And when we're hit on a mass scale like we were on 9/11 again, I'll blame you and your legalistic ideology in regards to notions of civil liberties for the atrocity.

The U.S. Governments Failed History Of Muslim Outreach Since 9/11
When President Obama hosted his annual iftar dinner in August to commemorate Ramadan, the list of invitees published by the White House was curiously missing the names of several attendees — all of whom are top leaders of organizations known to be purveyors of jihadist ideology. But it was not like they had crashed the party. One of the unlisted, Mohamed Magid, head of the Muslim Brotherhood-linked Islamic Society of North America, was photographed by Reuters sitting at the front table only a few feet from the president as he spoke.Read it all..This was just the most recent episode in the federal government’s disastrous attempts at outreach to the Muslim community since the 9/11 attacks. With the release of President Obama’s new strategic plan to combat “violent extremism” by expanding outreach to these same terror-tied groups, the present administration seems intent on compounding the problems wrought by its predecessors.
Misguided outreach activities began long before 9/11, with the best example being the case of Abdurahman Alamoudi.
Alamoudi was the conduit through which much of the U.S. government’s outreach was pursued following the 1993 World Trade Center bombing. Not only was he asked by the Clinton administration to help train and certify all Muslim military chaplains, his organization being the first to do so, but he also was appointed by the State Department in 1997 as a goodwill ambassador to the Middle East, making six taxpayer-funded trips. It is fair to say that during this period, Alamoudi was the most prominent and politically connected Muslim leader in America.
As we now know, Alamoudi was indicted in October 2003 for moving money on behalf of Libyan intelligence in an assassination plot targeting Saudi Prince (now King) Abdullah. The U.S. government has admitted that at the time he was being courted by Democrats and Republicans alike, he was a major fundraiser for al-Qaeda.
However, it is not as if the U.S. government was unaware of Alamoudi’s attachments. As far back as 1993, an informant told the FBI that Alamoudi was funneling regular payments from Osama bin Laden to Omar Abdel Rahman, the “blind sheikh” who was convicted of authorizing terror attacks against New York landmarks. In March 1996, Alamoudi’s association with Hamas leader Mousa Abu Marzook was exposed in the pages of the Wall Street Journal. Two years later, the State Department came under fire by the New York Post for inviting Alamoudi to official events despite his known remarks in support of terrorism and terrorist leaders.
When President Bush took office, Alamoudi was quickly courted by the new administration. In June 2001, the Jerusalem Post reported that Alamoudi was going to be part of a White House meeting with Vice President Cheney despite the fact that Alamoudi was known to have attended a terror confab in Beirut earlier that year featuring representatives from virtually every major Islamic terrorist organization in the world, including al-Qaeda.
Yet just days after the 9/11 attacks, Alamoudi was one of the Muslim leaders asked to appear with President Bush at the Islamic Center of Washington, D.C. That same week, one of Alamoudi’s close associates, Muzammil Siddiqi, was asked to deliver an Islamic prayer and to represent the entire Muslim-American community at the national prayer service mourning the fallen.[Continue reading]

U.S. Army Deserter Denied Asylum in Germany

(Frankfurt, Germany) The German Federal Office of Immigration and Refugees has denied the asylum request of U.S. Army deserter Andre Shepherd, 33.
Among other assertions, Shepherd claimed that the Iraq War is illegal and people are killed which put him in danger of committing war crimes. The German feds said something like, "What war crimes? You're a helicopter mechanic."
Shepherd's lawyer says a forced return to the U.S. to face desertion charges is "out of the question." More here and here.

Durbin, Illinois Democrat, announced the subcommittee hearing Tuesday, saying there has been a spike in anti-Muslim bigotry in the last year that demands closer attention.
“Our Constitution protects the free exercise of religion for all Americans,” Mr. Durbin said. “During the course of our history, many religions have faced intolerance. It is important for our generation to renew our founding charter’s commitment to religious diversity and to protect the liberties guaranteed by our Bill of Rights.”

DNI James Clapper: Egypts Muslim Brotherhood Largely Secular (Update: Video added)

During a House Intelligence Committee hearing Thursday, Director of National Intelligence James Clapper called Egypt's branch of the Muslim Brotherhood movement "largely secular."Fecking dhimmi, and he is Director of National Intelligence !?!?!!In response to questioning from Rep. Sue Myrick (R-N.C.) about the threat posed by the group, Clapper suggested that the Egyptian part of the Brotherhood is not particularly extreme and that the broader international movement is hard to generalize about.
"The term 'Muslim Brotherhood'...is an umbrella term for a variety of movements, in the case of Egypt, a very heterogeneous group, largely secular, which has eschewed violence and has decried Al Qaeda as a perversion of Islam," Clapper said. “TICKING TIME BOMB” FORT HOOD MASSACRE COULD HAVE BEEN PREVENTED
Committee Report Finds Internal Disputes, Poor Coordination at FBI and Failure to Acknowledge Violent Islamist Extremism at DOD
WASHINGTON – The Fort Hood massacre, which left 13 dead and 32 wounded, could have been prevented, Homeland Security and Governmental Affairs Committee Chairman Joe Lieberman, ID-Conn., and Ranking Member Susan Collins, R-Me., said Thursday, as they unveiled their report on the November 5, 2009, terrorist attack.
Evidence of accused killer Nidal Hasan’s growing drift toward violent Islamist extremism was on full display during his military medical training, although his superiors took no punitive action, according to the report. Two of his associates said he was a “ticking time bomb.” He had defended Osama Bin Laden and suggested Muslim Americans in the U.S. military might be prone to commit fratricide.
But, a slipshod FBI investigation into Hasan, coupled with internal disagreements and structural flaws in the agency’s intelligence operations also contributed to the government’s failure to prevent the attack.
DOD and FBI “collectively had sufficient information necessary to have detected Hasan’s radicalization to violent Islamist extremism but failed both to understand and to act on it,” the report states. “Our investigation found specific and systemic failures in the government’s handling of the Hasan case and raises additional concerns about what may be broader systemic issues.”
DOD Failures
The report tracks Hasan’s growing radicalization in the years before the attack and the numerous failures of the military to intervene or take action against him. For example, two officers described Hasan, during his medical residency and fellowship at Walter Reed Army Medical Center, as “a ticking time bomb.” At various times while he was at Walter Reed, Hasan suggested revenge might be a defense for the terrorist attacks of 9/11 and expressed sympathy with violent Islamist extremists and bin Laden. He also justified suicide bombers; said U.S. military operations represented a war against Islam; and stated that one of the risks of having Muslims in the U.S. military was the possibility of fratricide of fellow service members.
“The officers who kept Hasan in the military and moved him steadily along knew full well of his problematic behavior,” the report found. “As the officer who assigned Hassan to Fort Hood (and later decided to deploy Hasan to Afghanistan) admitted to an officer at Fort Hood, ‘you’re getting our worst.’”
Astonishingly, one of the reasons Hasan’s commanders claimed for not taking action against Hasan was a belief that the evidence of his growing radicalization actually provided an understanding of violent Islamist extremism and the culture of Islam. His Officer Evaluation Report for July 2007 to June 2008, for example, said Hasan’s work on the role of culture and Islamic faith in the context of terrorism “has extraordinary potential to inform national policy and military strategy.”
FBI Failures
The report also examines the all-too-cursory FBI investigation into Hasan’s activities when he came to the agency’s attention in early 2009; and the critical dispute, unresolved by FBI headquarters, between two Joint Terrorist Task Forces (JTTF) – the anti-terrorist intelligence units created in the aftermath of 9/11, comprised of federal, state, and local officials, and meant to facilitate intelligence information sharing and operational coordination.
On January 7, 2009, the San Diego JTTF sent a memo to the Washington JTTF about Hasan’s communications with a known terrorist already under investigation. Despite the red flags this should have raised, the Washington JTTF waited more than six weeks before assigning the investigation to an analyst from the Defense Department who was attached to the Washington JTTF. The analyst then waited until the last day of the customary 90-day deadline for completing inquiries and wrote his report in four hours, without considering the investigation from a counterintelligence perspective. Instead, he relied on Hasan’s sanitized Officer Evaluation Reports. The San Diego JTTF thought the inquiry was superficial but dropped the matter. FBI headquarters was never informed of, and played no role, in the Hasan investigation.
The FBI’s view of intelligence analysts from other agencies assigned to JTTFs compounded the problem. JTTF analysts from non-FBI agencies were not allowed full access to a key FBI database, which likely would have sparked a more in-depth inquiry.
Recommendations
The report found “compelling evidence that Hasan embraced views so extreme that he did not belong in the military.” It also found that FBI organizational problems have impeded the agency’s full use of intelligence analysts, concluding that the FBI’s “transformation into an intelligence driven, domestic counterterrorism organization needs to be accelerated.”
Among the report’s recommendations to strengthen our defenses against homegrown terrorism:
• DOD policies against extremism among service members must explicitly cover violent Islamist extremism. This is too important to be subsumed within policies aimed at “violent extremism” in general or “workplace violence.”
• Military equal employment rules and religious accommodations must clearly differentiate between violent Islamist extremism and protected religious observance. That way, the thousands of Muslim-Americans who serve our country honorably will be protected from suspicion for practicing their religion.
• Military employment evaluations and personnel records must accurately and candidly describe performance and behavior that could pose threats.
• The FBI needs to integrate its 56 field offices more effectively under headquarters leadership.
• The FBI needs to ensure that its JTTFs more convincingly share information and coordinate operations with other federal, state, and local agencies.
• The FBI must systematically update how it conducts its investigative activities. In the Hasan case, the FBI failed to identify all of Hasan’s communications with the suspected terrorist and the extent of the threat contained within them.
• The FBI needs to use intelligence analysts more skillfully. In the Hasan case, analysts were not consulted by the Washington Joint Terrorism Task Force to analyze his communications and help determine the objectives for the FBI’s inquiry.
• The U.S. must develop a national strategy to counter domestic terrorist radicalization. The reality is that even had the military dismissed Hasan before the attacks, our government would not have been well-positioned to counter his growing radicalization.
This report and its recommendations are particularly important given the dramatic increase in homegrown terrorist plots over the past two years. Thirteen people died needlessly at Fort Hood. Their memory will be served if the recommendations of this report are adopted quickly so the next “ticking time bomb” can be spotted early and defused before another deadly detonation.

Liz Cheney: Being lucky is not a responsible counterterrorism strategy
You know, when you're right you're really right. Convicting terrorists after the fact isn't a great preventative counterterror strategy.
I don't know if Mrs. Cheney is suggesting that Faisal Shahzad shouldn't have been prosecuted in a civilian court. If that is the case she is making, then I disagree. But she's certainly right about prevention.
One of you (can't remember who) sends me emails with this little quip at the bottom of each: I carry a gun because a police officer won't fit in my pocket.

Duh: Wiki Leaks Founder Anti-War Nut, Not Journalist
When the New York Times thinks you're out in Left field, you're really out in Left field. Andrew Exum on that assmuncher Julian Assange:
Mr. Assange says he is a journalist, but he is not. He is an activist, and to what end it is not clear. This week — as when he released a video in April showing American helicopter gunships killing Iraqi civilians in 2007 — he has been throwing around the term “war crimes,” but offers no context for the events he is judging. It seems that the death of any civilian in war, an unavoidable occurrence, is a “crime.”Remember, Assange called it "murder" when a helicopter engaged what were clearly enemy combatants carrying weapons. He himself later admitted that he had seen the weapons, but chose not to mention that fact in the dozens of interviews and press releases that surrounded the video showing the alleged "war crimes" until after he had been called out by us and the fact that weapons were unmistakably and clearly seen finally made it back to the MSM.If his desire is to promote peace, Mr. Assange and his brand of activism are not as helpful as he imagines. Which makes the so-called "journalist" either a combatant himself as he was showing Mahdi militia men pictures of a US military convoy when he was killed. Worst case scenario, he was in the wrong place at the wrong time. Bad things happen in war.
As for the van, see above and remember that part of the context Assange doesn't want you to know about is that the van had dropped off the combatants before the engagement. The lesson here is that you don't bring your kids to a firefight. It's sad, but the blame lies clearly with the insurgents.
But even after those facts had been established Assange continued to call for an investigation and claiming that there was a cover up of the incident despite knowing full well that the military had investigated it twice already and cleared the soldiers involved.
Which makes him more than a paranoid anti-war activist with an agenda, it also makes him a liar.

"It was a pay-to-play type of scheme," a Republican aide on the House Natural Resources Committee said of the millions Homeland Security has spent to date.
Rep. Rob Bishop, R-Utah, said the kicker in the multimillion-dollar tradeoff is that the money doesn't even guarantee the Border Patrol open access to the land.
